Access to records held by the University is generally governed by the Government Records Access and Management Act, Utah Code Annotated §§ 63G-2-101 to 901, as amended (“GRAMA”).

The first portion of your request, seeking “files, documents, email and text messages or any material relating to security involving and advance planning by the Utah Valley University Police Department” regarding the appearance of Charlie Kirk and what planning, if any, was done to understand the nature of these threats is denied as the records you seek are records regarding security measures undertaken by UVU. GRAMA provides that records regarding security measures that are designed for the protection of people or property are not subject to GRAMA. Utah Code Ann. § 63G-2-106. These records include, among other things, “security plans,” and “security procedures.” Utah Code Ann. § 63G-2-106(2)(a) and (d). Given this portion of your request specifically seeks security plans, this portion of your request is denied.

The second portion of your request includes a list of documents you are seeking to be included in your request for material related to security and advance planning, including:

  • Information regarding any threats received or understood by UVU before and after the appearance.
  • Whether information regarding these threats was provided to Turning Point USA, UVUPD, Utah Department of Public Safety, and the FBI.
  • Number of UVUPD members -- and their names -- assigned to the event.
  • Correspondence with Jeffrey Long, the police chief at UVU.
  • Correspondence with the Utah Department of Public Safety.
  • Correspondence with the FBI.
  • Correspondence with other law enforcement agencies.
  • Correspondence with Turning Point USA, including its security personnel.
  • News releases, announcements, or any information provided by UVU in advance of the event to the surrounding community through media of any kind.
 
 The first two bullet requests for information about threats received and whether that information was provided to other entities is denied for multiple reasons. First, Utah Code Annotated § 63G-2-204(1)(a)(ii) prescribes that a person making a request for a record shall submit to the governmental entity that retains the record a written request containing a description of the record that identifies the record with reasonable specificity. In these two bullet points, you seek information regarding any threats received or understood by UVU before and after the appearance,” but do not provide a time frame for the threats you are seeking, or an explanation as to what you mean by “threats.”

Even if you had provided sufficient information for our office to search for the requested records, any records of threats related to the event or threat response would be classified as protected as related to an ongoing criminal investigation and enforcement proceeding. A record is classified as protected if the record is created or maintained for “civil, criminal, or administrative enforcement purposes” and the record’s release could reasonably be expected to interfere with investigations undertaken for enforcement purposes, enforcement proceedings, or would create a danger of depriving a person of a right to a fair trial or proceeding. Utah Code Ann. § 63G-2-305(10)(a)-(c). As release of records relating to threats would reasonably interfere with investigations and enforcement proceedings, your request is denied.

Any records of threat response would also be a security measure that would not be subject to GRAMA under Utah Code Ann. § 63G-2-106. Utah Code Ann. § 63G-2-106 provides that records regarding security measures that are designed for the protection of people or property are not subject to GRAMA. Utah Code Ann. § 63G-2-106. These records include, among other things, “security plans,” and “security procedures.” 

Your request for the number of UVUPD members and their names assigned to the event is also denied as those records are also a record of security measures, and not subject to GRAMA. Utah Code Ann. § 63G-2-106.

You have five bullets requesting “correspondence” with Jeffrey Long, the police chief at UVU, the Utah Department of Public Safety, the FBI, other law enforcement agencies and with Turning Point USA, including its security personnel, without providing information about whose correspondence with these people you are seeking, the time frame for the records sought, or the key words or phrases to search for. This portion of your request is denied as it does not describe the records sought with reasonable specificity.

If you would like to make another request, please include, with reasonable specificity, the record types, custodians, a relevant time frame, or other search parameters you would like us to search for. Please be aware that pursuant to Utah Code § 63G-2-106, records of a governmental entity that could impair an ongoing investigation or enforcement proceeding are classified as protected and would not be released. § 63G-2-305(10)(a)-(c).
 
Your final bullet point requests, “News releases, announcements, or any information provided by UVU in advance of the event to the surrounding community through media of any kind.” We did not locate records responsive to this request.
